We recently received a phone call from a rather distressed landlord regarding a tenant who was in one of his commercial properties running a takeaway business in Sunderland.
They had not paid him rent for a number of months and had a debt of around £10,000. So the landlord instructed us for Commercial Rent Arrears Recovery (CRAR).
The tenant of the property ignored our original letters explaining the situation and had not made any attempt to pay in the allocated time so we then instructed one of our Enforcement Agents to go and visit the property.
The property itself was very bland with menus written on chalkboards and plastic seating. The tenant knew straightaway why the agent was there and immediately became quite impatient.
They entered into a discussion regarding the payment of the rent and were unable to reach any conclusion, with the tenant claiming they couldn’t afford a penny of it. This left the agent no option but to seize goods to cover the value of the debt.
With nothing of value being present in the front of the takeaway, he went behind the counter and through to the kitchen. There were bins overflowing, food was stuck to the floor and the walls, there were flies everywhere and slugs on the walls and cooking utensils. The filth even continued through to the cash office. Even the computer and phone were thick with grease and mould, absolutely nothing in the building could be seized.
Whilst outside on the phone to the office to explain the situation, the agent noticed a BMW parked outside the store next door and decided to use his initiative and check the ownership of the vehicle. The car belonged to the tenant. He clamped the vehicle straightaway and once he was back inside and told the tenant what he’d done this immediately persuaded the tenant into paying the full amount of outstanding rent!
A successful day in which we achieved full payment for the client using Commercial Rent Arrears Recovery (CRAR) and we also reported our agents findings to them regarding the extremely unhygienic way in which the property was being kept.
